This paper questions the dogmatic stance of the domestic courts toward mandatory orders for treatment, arguing that this has the potential to subjugate patients' interests to clinical discretion, and proposing a via media to accommodate the legitimate concerns of all parties.

Although workplace bullying is common and has universally harmful effects on employees’ outcomes, little is known about workplace bullies. To address this gap in knowledge, we draw from the tenets of social exchange and displaced aggression theories in order to develop and test a model of workplace bullying that incorporates the effects of employees’ individual differences, perceptions of their work environments, and perceptions of supervisory treatment on their tendencies to bully coworkers. The results of mediated moderation analyses that examine responses (...) from two samples of working adults support our hypotheses. Specifically, we find evidence of an indirect relationship between entitlement and coworker bullying through perceptions of abusive supervision that is stronger for employees who report lower levels of felt accountability than employees who report higher levels of felt accountability. This study makes important theoretical and practical contributions to abusive supervision research, bullying research, and organizational efforts to promote ethical work environments devoid of interpersonal mistreatment by providing novel insight into how employees’ entitlement and felt accountability combine to influence their tendencies to perceive themselves as victims of abusive supervision and culprits of coworker bullying. 1 Evidence-based policy requires researchers to provide the answers to ecological questions that are of interest to policy makers. To find out what those questions are in the UK, representatives from 28 organizations involved in policy, together with scientists from 10 academic institutions, were asked to generate a list of questions from their organizations. 2 During a 2-day workshop the initial list of 1003 questions generated from consulting at least 654 policy makers and academics was used as a basis for (...) generating a short list of 100 questions of significant policy relevance. Short-listing was decided on the basis of the preferences of the representatives from the policy-led organizations. 3 The areas covered included most major issues of environmental concern in the UK, including agriculture, marine fisheries, climate change, ecosystem function and land management. 4 The most striking outcome was the preference for general questions rather than narrow ones. The reason is that policy is driven by broad issues rather than specific ones. In contrast, scientists are frequently best equipped to answer specific questions. This means that it may be necessary to extract the underpinning specific question before researchers can proceed. 5 Synthesis and applications. Greater communication between policy makers and scientists is required in order to ensure that applied ecologists are dealing with issues in a way that can feed into policy. It is particularly important that applied ecologists emphasize the generic value of their work wherever possible. (shrink)

The arts of rule cover the exercise of power by princes and popular sovereigns, but they range beyond the domain of government itself, extending to civil associations, political parties, and religious institutions. Making full use of political philosophy from a range of backgrounds, this festschrift for Harvey Mansfield recognizes that although the arts of rule are comprehensive, the best government is a limited one.

Since the writings of Shiblī Nuʿmānī and A. J. Wensinck in the early twentieth century, scholarship has often questioned the ascription of the creed al-Fiqh al-akbar II to the well-known theologian and jurist Abū Ḥanīfa (d. 150/767). But there has hitherto been little attempt to determine how and when this text entered the Hanafi theological tradition and who its true author was. In this article I show that until the early eighth/fourteenth century, theological and biographical works referring to al-Fiqh al-akbar (...) consistently mean the text written by Abū Muṭīʿ al-Balkhī (d. 199/814), which was later renamed al-Fiqh al-absaṭ. I then trace the entry of al-Fiqh al-akbar II into the mainstream tradition, showing that the key figure in its popularization was the legal theorist ʿAbd al-ʿAzīz al-Bukhārī (d. 730/1329), who extensively quotes from the creed and attributes it to Abū Ḥanīfa. Finally, I propose that clues in the reception history and content of al-Fiqh al-akbar II corroborate the claim recorded in some texts that it was instead likely written by an obscure late fourth/tenth-century Hanafi scholar named Abū Ḥanīfa Muḥammad b. This long overdue English translation of Karl Löwith's magisterial study is a major event in Nietzsche scholarship in the Anglo-American intellectual world. Its initial publication was extraordinary in itself—a dissident interpretation, written by a Jew, appearing in National Socialist Germany in 1935. Since then, Löwith's book has continued to gain recognition as one of the key texts in the German Nietzsche reception, as well as a remarkable effort to reclaim the philosopher's work from political misappropriation. For Löwith, the centerpiece of (...) Nietzsche's thought is the doctrine of eternal recurrence, a notion which Löwith, unlike Heidegger, deems incompatible with the will to power. His careful examination of Nietzsche's cosmological theory of the infinite repetition of a finite number of states of the world suggests the paradoxical consequences this theory implies for human freedom. How is it possible to will the eternal recurrence of each moment of one's life, if both this decision and the states of affairs governed by it appear to be predestined? Löwith's book, one of the most important, if seldom acknowledged, sources for recent Anglophone Nietzsche studies, remains a central text for all concerned with understanding the philosopher's work. This chapter, ‘Friendship and the Moral Life in Iris Murdoch’s Novels’ revisits the subject of sexual relationships, not from the problematic perspective brought to them in Anne Rowe’s earlier chapter, but in a positive light. In his analysis of the educational potential of friendship and sexuality Robert Baker contends that sexual intimacy teaches Murdoch’s characters not only about themselves and their own identity but also about the reality of the other person. It thus acts as a force for learning to (...) attend to the world outside the self which is the desideratum of Murdoch’s moral pilgrimage. He surveys the apparent acceptance by Murdoch scholars that such moral development is necessarily a solitary and lonely endeavour before juxtaposing that impression—given prominence in the M and D scenario Murdoch creates in The Sovereignty of Good (1970)—with the relationships she portrays in her novels. Close readings of the friendship of Tom MacCaffrey and Emmanuel Scarlett-Taylor in The Philosopher’s Pupil (1983) and of Harvey Blackett’s relationship with Sefton Anderson in The Green Knight support Baker’s contention that physical affection can be a guide to the good. Borrowing an image from the latter novel he claims that in her fiction ‘Murdoch represents the moral life not as a lonely pilgrimage toward reality, but as a passeggiata with others in which one gives way to a movement larger than and beyond oneself’ (177), a viable interpretation which reads the passeggiata with an interestingly different slant from other current critics such as Rebecca Moden, who regards it as Murdoch’s ‘metaphor for the nature of human existence’ and ‘a troubling image of the impoverished quality of human consciousness in the late twentieth century’. Multiple -conclusion logic extends formal logic by allowing arguments to have a set of conclusions instead of a single one, the truth lying somewhere among the conclusions if all the premises are true. The extension opens up interesting possibilities based on the symmetry between premises and conclusions, and can also be used to throw fresh light on the conventional logic and its limitations. This is a sustained study of the subject and is certain to stimulate further research. Part I reworks (...) the fundamental ideas of logic to take account of multiple conclusions, and investigates the connections between multiple - and single - conclusion calculi. Part II draws on graph theory to discuss the form and validity of arguments independently of particular logical systems. Part III contrasts the multiple - and the single - conclusion treatment of one and the same subject, using many-valued logic as the example; and Part IV shows how the methods of 'natural deduction' can be matched by direct proofs using multiple conclusions.
